1. Acceptance of Terms
By accessing or using the RentPropPay platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
RentPropPay is a property management software platform that provides tools for managing rental properties, including but not limited to rent collection, maintenance requests, tenant screening, financial tracking, lease management, and communication tools.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use passwords that exceed minimum requirements and to implement two-factor authentication where available.
4. Subscription and Billing
RentPropPay offers subscription-based services with different tiers and pricing models. You agree to pay all fees or charges to your account based on the pricing and billing terms presented to you at the time of subscription.
We offer a 14-day free trial for new users. After the trial period, you will be billed according to the plan you select. You can cancel your subscription at any time, but no refunds will be issued for partial subscription periods.
5. User Content
Our Service allows you to upload, store, send, and share content, including but not limited to photos, documents, and communications with tenants and service providers ("User Content").
You retain all rights to your User Content. By uploading content to RentPropPay, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content solely for the purpose of providing and improving our services.
6. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Using the Service for any illegal purpose or in violation of any local, state, national, or international law
- Harassing, threatening, intimidating, or impersonating any other user of the Service
- Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable
- Attempting to circumvent, disable, or otherwise interfere with security-related features of the Service
- Collecting or harvesting any information from the Service, including other user accounts
- Using the Service in any manner that could damage, disable, overburden, or impair the Service
7. Fair Housing and Anti-Discrimination
Users of RentPropPay are required to comply with all applicable fair housing and anti-discrimination laws. The Service may not be used to discriminate against any protected class or to violate any fair housing laws. RentPropPay reserves the right to terminate the accounts of users who engage in discriminatory practices.
8. Intellectual Property Rights
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of RentPropPay and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RentPropPay.
9. Limitation of Liability
To the maximum extent permitted by law, RentPropPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
10. Indemnification
You agree to defend, indemnify, and hold harmless RentPropPay and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
- Your use and access of the Service
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right
- Any claim that your User Content caused damage to a third party
11. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service, or notify us that you wish to delete your account. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
